Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Menditect Testability Framework website and its content (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Scope of the Service

The Service provides various forms of intellectual property, including, but not limited to, technical documentation, coding standards, architectural guidelines, and small code elements ("Content").

2. Content Licensing (CC BY 4.0)

2.1 Core License

All original Content provided on this Service, including documentation, standards, and code elements (unless otherwise explicitly marked), is licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

2.2 Your Obligations

Under the CC BY 4.0 license, you are generally free to:

  • Provide the name of the creator Menditect B.V.

2.4 Exclusions and Third-Party Content

All Content on the Service is original work owned by Menditect B.V., unless otherwise explicitly marked. Menditect B.V. warrants that no third-party licenses (such as MIT, Apache, or GPL) govern the use of the original Content, and all such Content is subject solely to the terms of the CC BY 4.0 license and these Terms of Use.

3. User Obligations and Prohibited Conduct

By using the Service, you agree to the following:

  1. Accurate Use: You will use the Content only in accordance with the CC BY 4.0 license and these Terms.
  2. No Misconduct: You will not use the Service to upload, transmit, or distribute any material that is unlawful, harmful, defamatory, or infringes on any third party's rights (including intellectual property rights).

  4. No Unauthorized Access: You will not attempt to gain unauthorized access to any parts of the Service or its underlying systems.

5. Changes to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part of it) and to revise these Terms at any time. We will provide reasonable notice of any material changes. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.

6. Governing Law and Jurisdiction

Any dispute arising under this license shall be settled by arbitration in accordance with the Permanent Court of Arbitration (PCA) Arbitration Rules 2012. The seat of arbitration shall be Den Haag (The Netherlands). The number of arbitrators shall be one. The governing law of this license shall be the law of the Netherlands. You agree to submit to the exclusive jurisdiction of the courts located in The Hague to resolve any legal matter arising from these Terms.

For all general inquiries, please use the contact information provided at www.menditect.com. We ensure rapid, non-automated communication to address user concerns. Communications must be in English or Dutch.

7.2 Point of Contact for Authorities:

Pursuant to Articles 11 and 12 of the EU Digital Services Act (DSA), Menditect B.V. designates the following email address for direct communication with the Digital Services Coordinators, the European Commission, and the European Board for Digital Services: legal@menditect.com. Communications must be in English or Dutch.
